Clyde Robinson, wife accused of flipping Crown land PDF  | Print |  E-mail

Under Secretary in the Ministry of Environment and District Administration Clyde Robinson got a piece of Crown land for $70,000 and with the aid of his wife flipped it to a developer for $1.5 million while he was planning director, the government alleges in court documents dated Nov. 12.

“In view of the serious allegations against Mr. Robinson, he has been required to go on leave until these proceedings have been resolved,” the government announced in a press release today (Dec. 21). “No decision has yet been taken in relation to possible disciplinary proceedings.”

The government alleges that Robinson received a piece of Crown land in Long Bay Hills in March 2007 for $70,000 while he was director of planning, “owing a duty of good faith to (the government) and a duty not to put himself in a position where his personal interest conflicted with his duties and responsibilities.”

The land transfer contained a covenant requiring Robinson to use the land for his only residence or for the use of his family, but he gave it for no consideration to his wife, who sold it to a developer, Wawa Co. Ltd. in June 2007 for $1.5 million.

The government alleges that Robinson and or Mrs. Robinson “have been unjustly enriched, and it is unconscionable for them to retain the proceeds of sale, and that they are liable to account to (the government) for the profit from the sale, equalling $1,220,000 after payment of a Crown charge, as well as interest and costs.”

The government filed the action against Robinson and his wife, Susannah, on Nov. 12 but did not make it public until the court documents were served on Robinson. Mrs. Robinson has not yet been served.

Robinson was the long-time director of planning, overseeing all development proposals, until June, when he was transferred to his current position as under secretary in the Ministry of Environment and District Administration.

The allegations against the Robinsons are the second case of Crown land flipping filed by the Civil Recovery Team of lawyers retained by the interim government to go after government assets wrongly obtained under the previous administration.

The property is located at the northeastern end of Long Bay Hills in the same area where the property in the first case of alleged Crown land flipping is located.

In September, the government accused Richardson Anthony Arthur of getting title to Crown land there in January 2008 for $50,000 and 'flipping' it two months later to a developer for $1.35 million.

In both cases the government is asking the Supreme Court to force the defendants to pay the government the difference between what they paid for the property and the amount for which they sold it, plus interest and court costs.

The recovery team has said it is going after people and companies that allegedly received Crown land wrongly, as well as those who have not paid their Crown land leases.
